Terms of Use — The Picks

1. Acceptance of Terms

By accessing or using The Picks ("the Platform," "we," "us," or "our") at thepicks.co, you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the Platform. We reserve the right to update these terms at any time. Continued use of the Platform following any changes constitutes your acceptance of the revised terms.

2. Description of Service

The Picks is a social sports prediction platform that allows users to create and participate in pick'em pools for sports events. The Platform provides tools for organizing prediction contests among groups of friends, colleagues, or other private communities. The Platform is intended for entertainment purposes only.

3. No Gambling — Important Disclaimer

The Picks is not a gambling platform and must not be used for gambling purposes. The Platform does not facilitate, endorse, or support gambling of any kind.

The Picks does not collect, hold, process, or distribute money, prizes, entry fees, or any financial consideration on behalf of users or pool participants.
The Picks takes no responsibility for any monetary arrangements, entry fees, side bets, prize pools, or financial agreements made between pool participants, whether communicated through or independent of this Platform.
Any pool on the Platform that requires payment to participate is operated entirely at the discretion and risk of the pool organizer and participants. The Picks has no involvement in, knowledge of, or liability for such arrangements.
The Picks expressly disclaims all liability for gambling losses, failure to pay winnings, disputes over prize money, or any other financial harm arising from the use of this Platform.
You agree not to use this Platform in any jurisdiction where doing so would violate applicable gambling laws. You are solely responsible for ensuring your use of the Platform complies with the laws of your jurisdiction.

4. User Accounts

You must sign in using a valid Google account to use the Platform. You are responsible for all activity that occurs under your account. You agree to provide accurate information and to keep your account secure. We reserve the right to suspend or terminate accounts that violate these terms or that we determine, in our sole discretion, to be harmful to the Platform or other users.

5. Pool Organizer Responsibilities

If you create a pool on the Platform, you ("Pool Organizer") agree that:

You are solely responsible for the administration, rules, and conduct of your pool.
You will not use the Platform to operate illegal gambling or to collect entry fees in violation of applicable law.
You will not use the Platform to harass, defraud, or harm other participants.
The Picks bears no responsibility for disputes between pool organizers and participants, including any disputes about results, scoring, prizes, or payments.
You grant The Picks a limited license to display pool information to your pool's members for the purpose of operating the Platform.

6. Prohibited Conduct

You agree not to:

Use the Platform for any unlawful purpose or in violation of any applicable laws or regulations.
Attempt to manipulate, hack, or disrupt the Platform or its associated systems.
Impersonate any person or entity or misrepresent your affiliation with any person or entity.
Submit false or misleading information.
Scrape, crawl, or otherwise extract data from the Platform without our express written permission.
Attempt to gain unauthorized access to other users' accounts or data.

7. Intellectual Property

All content, design, logos, and software on the Platform are the property of The Picks or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission. Sports data displayed on the Platform is sourced from third-party providers and remains subject to their respective terms.

8. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy of any sports data, scores, results, or other information displayed on the Platform. You use the Platform at your sole risk.

9. Limitation of Liability

To the fullest extent permitted by applicable law, The Picks and its operators, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Platform. Our total liability to you for any claims arising from your use of the Platform shall not exceed the amount you paid us, if any, in the past twelve months.

10. Indemnification

You agree to indemnify and hold harmless The Picks and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause or notice, including if we believe you have violated these Terms. Upon termination, your right to use the Platform ceases immediately. Sections of these Terms that by their nature should survive termination will survive.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Platform shall be resolved in the applicable courts of the United States.
